These Terms and Conditions regulate the download, access, and use of the mobile application WellFast (hereinafter, the “APP”), which Apparent Group Limited owns and makes available to users on Google Play (Android) and Apple Store (iOS).

The user acquires this condition by downloading and using the APP. By accessing the APP, the user acknowledges having accepted and consented unreservedly to these terms of use and privacy policy.

1. RESPONSIBLE FOR THE APP

Apparent Group Limited, Company Registration number 73428962, (hereinafter “WellFast” or “we”), with registered office at FLAT/RM 0 5 – 0 6 HOLLYWOOD PLAZA, 6 1 0 NATHAN ROAD, 1 8 / F, KL, Hong Kong and email: hello@apparentgroup.co is the owner and responsible for the APP.

2. OBJECT

The APP has been developed to provide users with a comprehensive tool to support their intermittent fasting and health improvement journey. Through their mobile devices, users can track fasting periods, log health metrics (such as water intake, sleep, mood, and symptoms), access personalized programs and educational content, receive AI-assisted guidance, and engage with a supportive community.

3. COMPATIBLE DEVICES

The APP is available on Google Play (Android) and the Apple App Store (iOS). The user acknowledges and agrees to comply with all applicable terms and conditions of the respective application store regarding obtaining, downloading, and updating the APP.

4. GETTING STARTED

When starting the APP for the first time, the user will be guided through an onboarding process. This includes setting primary and secondary health goals (e.g., reduce inflammation, improve insulin sensitivity), providing information about any chronic conditions, and indicating their previous fasting experience. This information is used to personalize the user’s experience.

The user can configure notifications and reminders for fasting periods, hydration, and other activities. All this information can be modified at any time through the configuration panel available in the APP.

The APP operates on a freemium model. Users can access core features with a free version. To unlock all features, including advanced AI insights, full program access, and enhanced tracking, the user must subscribe to the Premium version (“WellFast Plus”) through the various payment plans available (e.g., weekly, annual). Payments are processed through the payment options offered by the Google Play Store or Apple App Store.

5. METHOD OF USE

The APP is structured around several key features to provide a holistic health management experience:

  • Home Dashboard: Displays the current fasting/eating timer, a daily log summary, and quick access to check-ins for meals, activity, sleep, water, symptoms, and mood. It also provides educational cards about fasting zones and daily tips.
  • Fasting Management: Users can select, customize, start, and stop various fasting protocols (e.g., 16:8, 18:6, OMAD). Progress is tracked and achievements are awarded for milestones.
  • Health Logging: Detailed check-in modules allow users to log specific data related to their health journey, including water intake, symptoms (on a severity scale), physical activity, sleep quality, meal details, and mood.
  • WellFast AI: An AI-powered companion that provides personalized guidance, answers questions, and supports the user’s health journey. Use of the AI is subject to understanding and accepting its limitations (i.e., it is not a substitute for professional medical advice).
  • Programs & Challenges: Users can join structured programs and challenges, such as a “7-Day Fasting Challenge,” designed to help them achieve specific health goals.
  • Learn Section: An educational hub with articles, guides, and personalized content related to fasting, nutrition, and overall wellness.
  • Community: A social feed where users can share their progress, ask questions, and interact with other members of the WellFast community by creating posts, commenting, and liking.

6. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The intellectual and industrial property rights over the APP are owned by Apparent Group Limited, which has exclusive rights to exploit them. The user acknowledges that the reproduction, modification, distribution, commercialization, or decompilation of any of the elements and utilities integrated within the development constitutes an infringement of the intellectual property rights of Apparent Group Limited.

6.1 User Content

Through the APP, users can create and share their own content, such as posts, comments, questions, and progress updates in the Community section (hereinafter “User Content”).

Users are solely responsible for the User Content they publish on or through the APP, including its legality, reliability, and appropriateness. By posting User Content, the user represents and warrants that: (i) the User Content is yours (you own it) and/or you have the right to use it and grant us the rights and license under these Terms, and (ii) the posting of your User Content on or through the APP does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity. We reserve the right to terminate the account of any person who infringes copyright.

You retain all of your rights to any User Content you submit. By posting User Content through the APP, you grant WellFast the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the APP. This license includes the right for us to make your User Content available to other users of the APP.

7. PRIVACY POLICY

In compliance with applicable regulations on personal data protection, we inform you that personal data provided by our users will be processed by Apparent Group Limited as Data Controller.

7.1 What personal data do we process?

We process data you provide to us and data we collect automatically.

  1. A) Data You Provide Directly:
  • Account Information: Name (optional), email address, and password to create and manage your account.
  • Health Profile & Onboarding Data: Age, weight, health goals, prior fasting experience, and information about chronic conditions or symptoms you choose to provide. This may be considered sensitive health data.
  • Daily Logged Data: Information you log within the app, including meal details, water and electrolyte intake, sleep duration and quality, physical activity, mood, and symptom tracking.
  • User-Generated Content: Posts, comments, and images you share in the Community section.
  1. B) Data We Collect Automatically:
  • Log and Usage Data: This includes information about your activity on the APP, such as features you use, taps, fasting session start/end times, pages viewed, and date/time stamps. This also includes device event information like crash reports.
  • Device Data: Information about your mobile device, including device identifier, model, operating system, language preferences, IP address, and browser type.
  • Push Notifications: We may request to send you push notifications regarding your fasting schedule, reminders, and account activity. You can disable these in your device settings.

7.2 Purposes and Legal Basis for Processing

Your personal data will be processed for the following purposes:

  • To Provide and Personalize Our Services: To set up and maintain your account, tailor fasting plans and content to your stated goals, track your progress, provide AI-driven insights, and enable your participation in the community. The legal basis is the performance of the contract between you and WellFast.
  • For Analytics and Service Improvement: To understand how users interact with the APP, identify areas for improvement, conduct research, and enhance the user experience. The legal basis is our legitimate interest in improving our services.
  • To Communicate With You: To send you service-related notifications, security alerts, and support messages. The legal basis is the performance of the contract and our legitimate interest.
  • For Marketing and Promotions: To send you information about new features, promotions, and other activities, with your explicit consent. You can unsubscribe at any time.

7.3 To whom do we provide your personal data?

We treat your information with confidentiality. We only share your data with third-party service providers who are strictly necessary to operate our APP. These include:

  • Cloud Storage and Backend Services: For data storage and application functionality (e.g., Amazon Web Services, Google Cloud).
  • Analytics Services: To help us understand app usage (e.g., Google Analytics, Mixpanel).
  • Payment Processors: To handle subscriptions through the app stores (i.e., Apple and Google).
  • AI/ML Service Providers: To power the “WellFast AI” feature. We take steps to ensure that data shared with these providers is handled securely.
  • Communication Services: For sending emails and push notifications.

We may also disclose your data to public authorities if required to comply with a legal obligation.

7.4 Minors

The APP is intended for users who are at least 13 years of age. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with information without your consent, please contact us. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information.

7.5 International Transfers

Our company is registered in Hong Kong. However, we use global third-party service providers (such as AWS, Google) that may be based in other countries, including the United States. Therefore, by using our APP, you acknowledge and consent that your personal data may be transferred to, stored, and processed in countries outside of your country of residence, where data protection laws may differ. We take appropriate contractual and technical measures to ensure your data is protected.

7.6 Exercise of Your Rights

You have the right to access, rectify, delete, limit the processing of, or request the portability of your personal data. You may also revoke your consent at any time. To exercise these rights, please send a written communication to hello@apparentgroup.co.

7.7 Security

We implement appropriate technical and organizational security measures to protect your personal data from alteration, loss, or unauthorized access. All data transfers are carried out using encrypted protocols (HTTPS).

7.8 Changes to the Privacy Policy

We may update this Privacy Policy from time to time. The updated version will always be available in the APP. We will notify you of any material changes through the APP or other communication channels.

8. RESPONSIBILITY & DISCLAIMER

WellFast provides information and tracking tools for health and wellness purposes only. The content and services provided by the APP are not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition before starting any new health regimen, including intermittent fasting. Never disregard professional medical advice or delay in seeking it because of something you have read on the APP.

WellFast disclaims any liability arising from failures, interruptions, or damages caused by system failures, malware, or other events beyond our reasonable control. The responsibility for the use of the APP rests solely with the user.

9. NULLITY AND INEFFECTIVENESS OF THE CLAUSES

If any clause included in these Terms and Conditions is declared totally or partially null and void or ineffective, such nullity or ineffectiveness shall only affect that provision, and the rest of the Terms and Conditions shall remain in force.

10. APPLICABLE LAW AND JURISDICTION

For any disagreement that may arise regarding the APP, these terms will be governed by the laws of the Hong Kong Special Administrative Region. Both parties submit to the exclusive jurisdiction of the courts of Hong Kong.

For users resident in the European Union, in case of a legal dispute in consumer matters, in accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides an online dispute resolution platform available at: http://ec.europa.eu/consumers/odr/.
